David appears for trials and hearings in state and federal courts
and before arbitration panels in Massachusetts, New York and throughout
the United States. He provides aggressive representation in every
case and believes that success in litigation is the result of
careful preparation and attention to client goals. David also
serves as a court-appointed receiver and private arbitrator for
commercial matters. He has enjoyed long-standing client relationships
because of his commitment to the highest level of service. David
works with individuals, local businesses and companies engaged
in national and international commerce. His experience includes
contract, employment, investment, regulatory, real estate and
intellectual property matters.
Experience Highlights
- One of David's clients recently received $3.9 million in a
pre-suit
settlement of a complex fraud claim.
- Recovered $2.5 million for a client in a transportation contract
dispute.
- Instrumental in obtaining a favorable arbitration award
against a Credit Suisse/First Boston affiliate, including nearly
$1 million in attorney's fees and costs.
- Represented a foreign dignitary
and recovered over $500,000 in a Florida-based arbitration.
- Obtained numerous favorable jury verdicts for individuals
and business clients in Berkshire County.
- Advises companies
on fast-developing trademark, copyright and e-commerce issues.
- Successfully litigated several Internet-related trademark
and copyright infringement claims in the federal District Court
for the Southern District of New York.
- Serves as an arbitrator
for the Financial Industry Regulatory Authority (FINRA).
- Appointed
as a Receiver by the Massachusetts Superior Court to oversee
a corporate liquidation.
In the Community
- David enjoys playing tennis, hiking and skiing. He also regularly
organizes alumni trips to University of Massachusetts basketball,
hockey and football games.
